Welcome to Greenwater Aquascapes. Greenwater Aquascapes will provide its services to you subject to the following conditions. When you visit or shop at the Greenwater Aquascapes’ website you agree to these terms and conditions. In addition, when you use any current or future Greenwater Aquascapes service or visit or purchase from any businesses associated with Greenwater Aquascapes, whether or not included in the Greenwater Aquascapes website, you will be subject to the guidelines and conditions applicable to such service or business.
In these Terms and Conditions references to “You”, “Your”, ”User” shall mean the end user accessing this website, its contents and using the Services offered through this website, and the references “We”, “Us” and “Our” shall mean Greenwater Aquascapes & it’s website.
Terms and Conditions relating to the sale of the plants
Our Contract
Your order is an offer to us to buy the plant(s) in your order. When you place an order to purchase a plant from us, you will receive an e-mail confirmation of your order, containing the details of the plant(s) care product purchased. The email confirmation is only an acknowledgement that we have received your order, and in no way confirms the acceptance of your offer to buy the plant(s) ordered. We only accept your offer, and conclude the sale after we receive the payment in full for the plant(s)/ plant care product ordered, dispatch the plant(s)/ plant care product and then send out an email confirming dispatch of the plant(s)/ plant care product to you. Plant(s) and plant care products will be dispatched separately, If your order is dispatched in more than one package you may receive a separate e-mail confirmation for each package. So we request you to please check the details of the plant(s)/ plant care products ordered in each email.
Eligibility Criteria
The services of Greenwater Aquascapes are only available to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are incompetent of fulfilling the terms of the contract as per the Indian Contract Act, 1872 i.e. minors, etc. are not eligible to use the website. Greenwater Aquascapes reserves the right to terminate your membership account and / or refuse to provide you access to the website if it brought to Greenwater Aquascapes’s notice that you are not eligible to form a legally binding contract under the Indian Contract Act 1872. If you are a minor as per the law, you may purchase from us only with the involvement of a parent or guardian.
Online services of Greenwater Aquascapes is open for domestic (Indian territory) customers only, If you are an overseas customer we request you to get in touch with us through the contact details provided in ‘Contact Us’ page.
Communications
You will be required to provide a valid phone number while placing an order from us. We may communicate with you by e-mail, SMS, phone call or by any other method of communication. When you send us e-mails, other data material or communication to us or use the website, you are communicating with us electronically and for contractual purposes, you consent to receive communications as stated above from us with respect to your purchase / order.
Shipping:
Plants will be shipped the next working day after the order is placed and a full payment confirmation is received. We ship on all days of the week except Friday, Saturday, Sunday and public holidays. You may be required to collect the shipment from the nearest courier office to avoid delivery delays. We need to keep in mind that plants are perishable.
If the plant(s) that you place an order for becomes unavailable, we will promptly call / inform you electronically within two working days of your purchase and fully refund the money for the out-of-stock item or replace it with a plant(s) of your choice and of the same/more value.
Payment Options
Greenwater Aquascapes will allow users to purchase plant(s) using only the following forms of payment.
- Credit Cards
- Debit cards
- Net Banking
Payments have to be made in full and the items will be shipped only after we receive the payment confirmation. Please note that payments can only be made in Indian Rupees (INR) and all the above payment instruments must have been issued by legal entities that are subject to Indian regulations and are operational in India.
Delivery time:
Greenwater Aquascapes sends out plant(s) shipments on all days of the week except Friday, Saturday, Sunday and public holidays. If an order is placed with us before 06:00 a.m. we will ship the item out on the same day. For all orders placed after 06:00a.m. we will ship the item the following shipping day. After that the delivery time is 2 to 3 business days.
Greenwater Aquascapes will not be held accountable for the following delivery failures:
- Delay of delivery due to unforeseen circumstances by the courier company.
- Failed delivery attempts: Usually a delivery is attempted 3 times before the package is returned. We request you to make sure that you are available to receive your package in the 1st attempt itself as plant(s) are perishable and need immediate care and attention as soon as they reach you. If we receive the package back due to failed delivery, it will be considered as a sale anyways and no refund will be issued.
- Incorrect Address: Greenwater Aquascapes does not take responsibility if the delivery address furnished by you to us is incorrect or outdated. We do not ship to Post Office Box addresses. If the package is returned to us due to these reasons it will be considered as a sale and no refund will be issued.
- If delivery address is outside of courier service area, door delivery will not be possible and the package should be collected directly from the courier office.
- Risk of loss: All plant(s) purchased from Greenwater Aquascapes are made pursuant to a shipment contract. This means that the risk of loss for such items pass to you upon delivery to the carrier.
- Refused by Recipient: If you are sending a gift, please make sure that the addressee is aware of the package arriving. If the package is refused and returned to us due to whatever reason, it will still be considered as a sale and no refund will be issued.
- If the shipment is not delivered within the expected time, please follow up with the courier company and also inform us.
- Plants are shipped by priority shipping and plant care products by surface shipping
Packing and Shipping charges
We offer free shipping for plant orders above Rs. 2500/-
Minimum order
We only accept plant(s) orders starting from Rs. 300/- and above. This amount is not inclusive of shipping. The total value of the plant(s) purchased has to be a minimum of Rs. 300/- inclusive of taxes.
Pricing and availability
All prices are listed in Rupees (INR). The prices are inclusive of all taxes (shipping charges extra).
If the plant(s) that you place an order for becomes unavailable, we will promptly call / inform you electronically within two working days of your purchase and fully refund the money for the out-of-stock item or replace it with a plant(s) of your choice and of the same/more value.
Cancellation
All cancellation requests have to reach us on or before 1:00 a.m. of the shipping day. All you need to do is send us a cancellation request on admin@greenwateraquascapes.com
Once shipped, the order cannot be cancelled, and the order will be considered as sold and no refunds will be issued.
Return Policy:
We do not have a return policy as plants are perishable goods.
User Account, Password and Security
Upon completion of the registration process on Greenwater Aquascapes’ website(s), you will receive your username and password. If you use this site you are solely accountable for limiting access to your computer, maintaining the privacy of your username and password and are completely responsible for all activities that occur under your account or password. We request you to immediately inform us of any unauthorized use of your account or password or any other breach of security. Greenwater Aquascapes reserves the right to refuse access to the website, terminate accounts, remove and/or edit content or cancel orders at our sole discretion. Greenwater Aquascapes cannot and will not be held liable for any loss or damage arising from your failure to comply with the terms and conditions.
Privacy
We request you to please read our Privacy Policy notice which also directs your use of Greenwater Aquascapes and enables you to understand our policies and practices. All the information that you provide us when you use the website will be treated as strictly confidential, in agreement with the Information Technology Act 2000 and the applicable laws and regulations. If you have any objections to your information being used in such a manner, please do not use the website.
Licence for use of the Website
Greenwater Aquascapes grants you limited licence to access and make personal use of this website. You cannot download (other than saving the page) or change any portion of it or modify it without express written consent from Greenwater Aquascapes. This authorization does not include any resale or commercial use of this website or its contents. Applicable Law
By using Greenwater Aquascapes you agree that the terms and conditions are governed by and interpreted in accordance with the laws of India. You agree as we do, to submit to the exclusive jurisdiction of the courts in Kottayam, Kerala, India.
